JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.4 in Crime No.132 of 2026 registered by Kunigal Police Station, Tumakuru for offences punishable under Sections 118(1), 115(2), 109 r/w 3(5) of BNS 2023 is before this Court in this petition filed under Section 483 of BNSS 2023 seeking regular bail. 2. Heard the learned counsel appearing for the parties. 3. FIR in Crime No.132 of 2026 was registered by Kunigal Police Station, Tumakuru for the aforesaid offences against Govinda and two others. In the said case, petitioner herein was arrested on 16.04.2026 and subsequently, remanded to judicial custody. His bail - 3 - HC-KAR NC: 2026:KHC:31687 CRL.P No. 6981 of 2026 application filed before the Jurisdictional Court in Crl.Misc.No.619 of 2026 was rejected on 27.04.2026. Therefore, he is before this court. 4. First information in the present case is filed by one Mr.Ramachandra, who is one of the injured in the incident that had taken place on 10.04.2026 at about 22.00 hours. The first information was filed on 11.04.2026 at about 16.40 hours. In the first information, allegation is made only as against three persons who are named in the FIR as accused Nos.1 to 3. Based on the subsequent statement of the injured first informant, that was recorded on 13.04.2026, petitioner herein was arraigned as accused No.4 in the present case and was arrested on 16.04.2026. Major portion of the investigation is already completed. Considering the fact that it is only based on the subsequent statement, which was recorded after a period of three days, from the alleged date of the incident, the petitioner was arraigned as an accused in the present - 4 - HC-KAR NC: 2026:KHC:31687 CRL.P No. 6981 of 2026 case. I am of the opinion that the petitioner is entitled for the relief sought for. Hence, the following: ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.132 of 2026 registered by Kunigal Police Station, KGF, for the offences punishable under Sections 118(1), 115(2), 109 r/w 3(5) of BNS 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the like-sum, to the satisfaction of the Jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 5 - HC-KAR NC: 2026:KHC:31687 CRL.P No. 6981 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
