JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court seeking the following prayers: "i. CALL for records ii. QUASH the proceedings FIR in Crime No.29/2026 of Respondent Police, pending on the file of XLVI ACJM, Bengaluru, for the offences punishable U/Sec. 189(2), 191(2), 191(3), 126(2), 109, 352, 190 of Bharatiya Nyaya Sanhita (BNS), 2023, in the interest of justice. iii. ALLOW the above criminal petition in the interest of justice and equity.” 2. Heard Sri. Ko. Vijayakumar, learned counsel appearing for the petitioners, Smt. Waheeda M.M, learned HCGP appearing for respondent No.1, Sri.Shivananda D.S, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have - 4 - HC-KAR NC: 2026:KHC:30536 CRL.P No. 3285 of 2026 filed a Joint Memo/Compromise Petition. The said Joint Memo/Compromise Petition reads as follows: “1. The respondent No. 2 lodged the complaint before the respondent No. 1 police station in Cr. No. 29/2026 for the offence punishable under section 189(2), 191(2), 191(3), 126(2), 109, 352, 190 of BNS, and the same was pending before the Hon'ble XLVI ACJM, Bangalore City. 2. The petitioners submits that, the petitioners are enlarged on bail in Crl.Misc. No. 1194/2026 dated 05-02-2026 passed by the Hon'ble City Civil and Sessions Judge, Bangalore city. 3. The petitioners submits that, thereafter both the parties were compromised, and the petitioners have filed the above petition to quash the proceedings before this Hon'ble Court. 4. The petitioners and the respondent No. 2 has amicably settled the issues, as they are friends, and unexpectedly the incident has been occurred, hence both the parties are compromised the issues. 5. The petitioners submits that, for the same cause of action the petitioner No. 1 has also lodged the complaint before the respondent No. 1 police in Cr. No. 30/2026 for the offence punishable under section 126(2), 118(1), 351(2), 352 R/w 3(5) of BNS, against the complainant and others. The said case has been also compromised before the competent court. 6. The petitioners submits that, all the petitioners and the complainant in the both the cases were aged about 23 to 25 years, and they are the only bread earners of their respective family members, and there is no any bad antecedents against them, and there is no any criminal back grounds against the parties. Hence be pleased to consider the above said joint memo/ compromise petition and pass necessary Orders for the bright future of the petitioners and the respondent No.2. - 5 - HC-KAR NC: 2026:KHC:30536 CRL.P No. 3285 of 2026 7. Both the Petitioners and the Respondent No.2 have agreed to co-operate each other to close the proceedings in Crime No.30/2026 filed by the Petitioner No.1 and the Crime No.29/2026 filed by the Respondent No.2. by withdrawing the allegations. Wherefore, the petitioners and respondent No.2 respectively pray that this Hon'ble Court may be pleased to take the Joint Memo / Compromise Petition on record as per the above terms and conditions, and quash the proceedings FIR in Crime No. 29/2026 of Respondent police, pending on the file of XLVI ACJM, Bengaluru, for the offences punishable U/Sec. 189(2), 191(2), 191(3), 126(2), 109, 352, 190 of BNS, 2023 in the interest of justice and equity.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of Joint Memo/Compromise Petition filed by parties to the lis, I deem it appropriate to accept the said Joint Memo/Compromise Petition and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. - 6 - HC-KAR NC: 2026:KHC:30536 CRL.P No. 3285 of 2026 [II] Proceedings in Crime No.29/2026, pending on the file of XLVI ACJM, Bengaluru, stands quashed qua the petitioners.
