TUMUCHERLA VILLAGE, KANAGANAPALLI MANDAL, ANANTAPUR DISTRICT. 515641 ...RESPONDENT(S): Counsel for the Petitioner: K SRINIVAS Counsel for the Respondent(S): GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to direct the respondents 2 and 3 not to interfere with the civil dispute in respect of Sy No. 418/2 for an extent of Ac. 3. 38 cents situated at Thumucherla village Kanaganapalli Mandal Sri Sathya Sai District as illegal arbitrary and unconstitutional and consequently direct the respondents nos 2 and 3 not to interfere with the petitioner in respect of Sy No. 418/2 for an extent of Ac. 3. 38 cents situated at Thumucherla village Kanaganapalli Mandal Sri Sathya Sai District in any manner in connection with the said civil dispute except in accordance with law and pass….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3 Dr. YLR, J W.P.No.13540 of 2026 Dated 08.05.2026 3. Mr. K. Srinivas, learned counsel for the petitioner, submits that respondent Nos.2 and 3 are interfering in the civil disputes in respect of Sy.No.418/2 admeasuring Ac.3.38 cents situated at Thumucherla Village, Kanaganapalli Mandal, Sri Sathya Sai District. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, submits that the petitioner claims title and possession over the subject property in Sy.No.418/2 admeasuring Ac.3.38 cents on the basis of assignment made by the competent revenue authorities and issuance of D-Form patta, and that her name is reflected in the revenue records including pattadar passbook, title deed and adangal maintained at Mee-Seva/Kanaganapalli. 5. The learned Assistant Government Pleader further submits that the unofficial respondents are also claiming right and ownership over the very same property and, in that regard, the petitioner has already instituted a civil suit in O.S.No.34 of 2018 on the file of the learned Junior Civil Judge, Dharmavaram, which is pending adjudication. It is further submitted that, since the matter is already sub judice before the competent Civil Court and the dispute is purely civil in nature, the revenue authorities advised both parties to work out their remedies before the competent Civil Court. Accordingly, an appropriate reply was also submitted to the PGRS petition filed by the petitioner vide File No.SSTS202512155119 dated 15.12.2025. Therefore, the learned Assistant Government Pleader submits that no further action is required on the part of the respondent police. 4 Dr. YLR, J W.P.No.13540 of 2026 Dated 08.05.2026 6. Having regard to the entire facts and circumstances of the case, and recording the submissions made by the learned Assistant Government Pleader, this Writ Petition is disposed of directing the respondent police not to interfere henceforth in the civil disputes pending between the petitioner and the unofficial respondents, without following due process of law. However, in the event of registration of any crime against the petitioner, the investigating officer is at liberty to proceed against the petitioner in accordance with law. 7. In the result, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
