OMP(M) No. 609 of 2026 The instant application has been filed under Section 5 of the Limitation Act for condonation of delay of 34 days in filing the appeal. It has been contended in the application that the impugned judgment dated 09.04.2026 was passed by the learned District Judge, Mandi, HP. It has been further contended that the office clerk of the learned counsel for the applicant applied for a certified copy on 09.04.2026, and the same was prepared on 18.04.2026 and delivered on 05.06.2026. As per the averments made in the application, the certified copy got misplaced in the office of the learned counsel and was retrieved only on 25.07.2026. Immediately thereafter, steps were taken for obtaining the entire case record and to file the present appeal. The delay in filing the appeal is neither intentional nor willful, but the same has occurred under unavoidable circumstances. Learned counsel for the respondents have no objection in case the present application is allowed. Consequently, in view of the averments made in the application, which is duly supported by an affidavit, and in view of the no-objection made by learned counsel for the respondents, the present application is allowed and the delay in filing the appeal is condoned.
