Ms. Mamta Bisht, learned Deputy Advocate General for the State vehemently argued that petitioner has remedy of approaching the Tribunal established under U.P. Public Service (Tribunals) Act, 1976. 5. Learned counsel for the petitioner, however, submits that petitioner wants to file departmental appeal under Rule 11 of Government Servant (Discipline and Appeal) Rules, 2003, as amended in 2010. 6. Since remedy of departmental appeal is available to petitioner, therefore, the writ petition is disposed of with liberty to petitioner to approach the Appellate Authority by filing an appeal. If he files appeal within ten days from today, the same shall be heard and decided on merits.
