( 2026:JHHC:26322 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 8102 of 2026 ------ 1. Raj Kumar Ram, aged about 26 years, son of Shiv Prasad, resident of Road No. 6, Keshav Nagar Kishor Ganj, Ranchi, P.O.-G.P.O. Ranchi, P.S.-Sukhdeonagar, Dist.-Ranchi 2. Bunty Kumar @ Bunty Kumar Thapa @ Banti Thapaa, aged about 20 years, son of late Raju Lohra, resident of Milan Chowk Khadgarha, Ranchi, P.O.-Hehal, P.S.- Sukhdeonagar, Dist.-Ranchi … Petitioners Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioners : Mr. Nilesh Kumar, Advocate For the State : Ms. Priya Shrestha, Spl. P.P. ------ Order No.02 Dated- 01.09.2026 Heard the parties. The petitioners have moved this Court for grant of bail in connection with Namkum P.S. Case No.214 of 2026(N) registered for the offences punishable under sections 23/20(b)(ii) (A)/ 25/27(a)/29 of the N.D.P.S. Act. The learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners were involved in illegal possession of total 10.70 grams of Hydroponic ganja called ‘OG’ and from the possession of petitioner no.1, 5.30 grams of Hydroponic ganja called ‘OG’ and from the possession of the petitioner no.2, 5.40 grams Hydroponic ganja called ‘OG’ were recovered. It is further submitted that the allegations against the petitioners are all false and even if the seized ganja is considered cannabis still the same comes under small quantity which attacks maximum punishment of one year; therefore as per the Schedule of Bharatiya Nagarik Suraksha Sanhita, 2023, the offence is a bailable offence, of course, in view of Section 37 (1) (a) of N.D.P.S. Act, the offence is a cognizable offence. It is next submitted that the petitioners have no criminal antecedent as has been mentioned in paragraph no.20 of the bail application. It is then submitted that the petitioners have been in custody since 09.08.2026, as has been mentioned in paragraph no. 19 of the bail application. It is next submitted that the petitioners undertake to cooperate with the trial of the case and further undertake that they will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioners be admitted to bail. The learned Spl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioners on bail. Accordingly, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Commissioner-cum- Special Judge, Ranchi, in connection with Namkum P.S. Case No.214 of 2026(N) with the condition that the petitioners will cooperate with the trial of the case and will furnish their mobile numbers and a copy of their Aadhar Cards in the court below with the undertaking that they will not change their mobile numbers during the trial of the case, with further condition that they will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
