PILLIX LAW FIRM Counsel for the Respondent/complainant(S): 1. SOMISETTY GANESH BABU 2. PUBLIC PROSECUTOR 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 8157/2024 ORDER: This Criminal Petition is filed seeking cancellation of the anticipatory bail granted to the accused/respondent No.2 vide order dated 10.10.2024 in Crl.P.No.6417 of 2024 in Crime No.202 of 2024 of Tirchanur Police Station, Tirupathi District. 2. Heard Sri P.Aditya Harsha Vardhan, learned counsel representing M/s. Pillix Law Firm, for the petitioner/defacto complainant, Ms. K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State and Sri Somisetty Ganesh Babu, learned counsel for the respondent No.2/accused. 3. Learned counsel for the petitioner would submit that the present petition is filed seeking cancellation of the bail granted by a Coordinate Bench of this Court in Crl.P.No.6417 of 2024 vide order dated 10.10.2024 to the respondent No.2/accused. The petitioner herein is challenging the sustainability of the order on the ground that notice was not issued to the defacto complainant to submit their objections. 4. Learned counsel for the respondent No.2/accused, would submit that this Court has no jurisdiction to entertain this petition since it is not filed on point that the accused violated any conditions imposed while granting bail. 5. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. 4 6. In light of the submissions made, the prayer in the petition and the affidavit would show that the grievance of the petitioner is that no notice was served on the de facto complainant at the time of hearing the petition, i.e., Crl.P.No.6417 of 2024. As rightly contended by the learned counsel for Respondent No. 2, the challenge raised in the present petition is regarding the sustainability of the order passed in the said petition. This Court has no jurisdiction to examine or interfere with those aspects. 7. At this juncture, learned counsel for the petitioner would submit that the petition may be disposed of giving liberty to the petitioner to work out their remedies before the appropriate forum. 8. In that view of the matter, this Criminal Petition is disposed of. However, the petitioner is at liberty to workout her remedies before the appropriate forum. Consequently, miscellaneous applications pending, if any, shall stand closed. __________________________________________ DR. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 02.03.2026.
