( 2026:JHHC:26197 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI
B.A. No. 8069 of 2026
------ Anand Sahis, aged about 28 years, son of Sri Kalu Sahis, resident of Sundarpur, Jamshedpur, P.O. & P.S. –Patamda, District –East Singhbhum.
… Petitioner
Versus The State of Jharkhand … Opposite Party
------
CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Mr. Rajesh Kumar, Advocate For the State
: Mrs. Mohua Palit, Addl. P.P. ------
Order No.02 Dated- 31.08.2026
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with S.T. Case No. 198 of 2025 arising out of Patamda P.S. Case No.23 of 2024 corresponding to G.R. Case No. 458 of 2025 registered for the offences punishable under sections 103(1)/3(5) of the B.N.S., 2023.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons has committed the murder of Subhash Sahis. It is further submitted that the allegations against the petitioner are all false. It is then submitted that so far two witnesses have been examined but they have not supported the case of the prosecution and have turned hostile. It is further submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail.
The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that the informant and the other material witnesses of the case are yet to be examined and the two witnesses being the P.W.1 is the relative of the accused persons
and the petitioner and P.W.2 is the neighbor of the accused person, so it is unlikely that they will adduce evidence against the petitioner, therefore, it is irrelevant that they have supported the case of the prosecution or not but in view of direct allegation against the petitioner of having committed the murder of Subhash Sahis, there is every chance of the petitioner absconding and tampering with the evidence if released on bail. Hence, it is submitted that the petitioner ought not to be admitted to bail.
Considering the serious nature of allegation against the petitioner of committing the murder of Subhash Sahis and the chance of the petitioner absconding and tampering with the evidence if released on bail, this Court is not inclined to admit the petitioner on bail.
Accordingly, the prayer for regular bail of the above-named petitioner is rejected.
