Sri.B.L.Sanjeev., learned counsel entered appearance for respondent No.2. Hence, registry is directed to delete the name of Sri.Pavan Kumar., learned counsel as that appearing for respondent No.2. 2. The petitioner is before this Court seeking for the following reliefs: a. Grant a writ, order or direction in the nature of Mandamus directing the Respondents to settle the unpaid bills raised towards the purpose of the conducting COVID-19 RT-PCR Tests during the period of 2020-2022 amounting to INR. 1,83,87,600/- (Rupees One Crore Eighty Three Lakhs Eighty even Thousand and Six Hundred only) by Petitioner forthwith, as represented by the Petitioner in its letter dtd 11.11.2022 as contained in ANNEXURE-D; and b. Pass such other order, direction or orders as this Hon'ble Court may deem fit in light of the facts and circumstances of the case, in the interest of justice and equity. - 3 - HC-KAR NC: 2026:KHC:30736 WP No. 13124 of 2025 3. The grievance of the petitioner is that the Petitioner- Diagnostic center had rendered services in carrying out Rapid Antigen Test (RAT) and Reverse Transcription-Polymerase Chain Reaction (RT-PCR) tests during the COVID-19 period in terms of circular dated 31.12.2021. In pursuant thereto, the petitioner having submitted its bills, the bills have not been cleared and it is in that background that the petitioner is before this Court seeking for the aforesaid relief. 4. Whenever any services are rendered by a citizen or a company to the governmental authority, it is required that they be considered necessary payment made in terms of the applicable norms and the agreement arrived at. 5. In the present case, the submission of the learned counsel for the petitioner is that the services rendered in the year 2020-2022 have not been paid for. As such, I pass the following; ORDER i. The writ petition is allowed. ii. A mandamus is issued, directing respondents to consider the representations of petitioner dated 11.11.2022 at Annexure-D and dated 18.12.2023 at Annexure-E in terms of the work - 4 - HC-KAR NC: 2026:KHC:30736 WP No. 13124 of 2025 order, notification and such documents as that govern the relationship between the petitioner and respondent No.2 and pass necessary orders within a period of four weeks from the date of receipt of a copy of this order. iii. It is made clear that the order passed ought to be as per the above documents. This Court has not rendered any opinion on the entitlement of the petitioner.
