GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ, Order or Direction, more particularly one in the nature of WRIT OF MANDAMUS, declaring the action of the Respondent No. 6 in not furnishing and not producing the final report/closure report in FIR No. 30 of 2013 on the file of Pendurthi Police Station, Visakhapatnam as illegal, arbitrary, capricious and violative of Articles 14 and 21 of the Constitution of India, and consequently direct the Respondent No. 6 to forthwith place before this Honble Court as well as the Jurisdictional Magistrate the final report/closure report purportedly filed, along with the entire case diary, refer report, and all connected records pertaining to the investigation within a time frame fixed by this Honble Court…” 2. Heard the learned counsel for Petitioner and learned Assistant Government Pleader. 3. Ms. Meghana Dulla, learned counsel for the Petitioner, submits that Respondent No.6 is not furnishing or producing the final report/closure report in F.I.R.No.30 of 2013 on the file of Pendurthi Police Station, Visakhapatnam. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, submits that Respondent No.6 will duly furnish and produce the final report/closure report in F.I.R.No.30 of 2013 on the file of Pendurthi Police Station, Visakhapatnam, before the competent Court in accordance with law. 3 5. Having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing the Respondent No.6 to submit the appropriate proceedings before the learned jurisdictional Magistrate, whether by way of final report, closure report, or charge sheet, in Crime No. 30 of 2013 on the file of Pendurthi Police Station, Visakhapatnam, within a period of two (02) weeks from the date of receipt of this order, inasmuch as the crime was registered more than a decade ago. The Respondent No.6 shall also submit an appropriate report to Respondent No.3/Commissioner of Police, Visakhapatnam. A copy of the proceedings filed by the Investigating Officer before the learned jurisdictional Magistrate shall also be furnished to the Petitioner under proper acknowledgment within a period of three (03) weeks. 6.
