1. Heard Mr Rajesh Kumar, the learned counsel for the appellant, Ms Neeharika Roy Mazumdar, learned A.C. to A.G. for the respondents-State, and Mr Sanjay Piprawall, the learned counsel for the respondents-JPSC. Neutral Citation No. 2026:JHHC:25815-DB
2. This appeal challenges the learned Single Judge’s order dated 20th January 2026 disposing of W.P.(S) No. 459 of 2023 and connected matters. 3. Mr Rajesh Kumar, in his contentions, submits that the petitioners in three out of the five petitions, which were disposed of by order dated 20th of January 2026, have filed Special Leave Petitions before the Hon’ble Supreme Court bearing S.L.P. Nos. 12658 of 2026, 13543 of 2026 and 10132 of 2026, in which notices have also been issued in this regard. Accordingly, he submits that we should keep this matter pending until the Hon’ble Supreme Court disposes of the three Special Leave Petitions. 4. As of now, the learned Single Judge has observed that the issue raised has already been set to rest by the Full Bench of this Court in the case of Dr. Nutan Indwar @ Nutan Indwar v. State of Jharkhand and Others in L.P.A. No. 64 of 2020. 5.
The learned Single Judge has also referred to the Hon’ble Supreme Court’s decision in the case of Mohit Kumar v. State of Uttar Pradesh and Others, 2025 SCC OnLine SC 1125, which was relied upon by the Full Bench in the case of Dr Nutan Indwar (supra). 6. The decision of the Full Bench was binding on the learned Single Judge, and this will also bind this Court, which is hearing the appeal against the learned Single Judge’s order. Incidentally, even the Full Bench had relied on the decision of the Hon’ble Supreme Court in

Mohit Kumar (Supra). Accordingly, it would not be proper to keep this matter pending. 7. For the above reason, we dismiss this appeal by relying upon the decision of the Full Bench of this Court in the case of Dr Nutan Indwar (supra) and the decision of the Hon’ble Supreme Court in the case of Mohit Kumar (supra). No costs. 8. IAs, if any, pending in this appeal, will not survive and are disposed of. (M. S. Sonak, C.J.)
