By way of this application, a prayer has been made by the applicants/petitioners for condonation of delay in filing the Revision Petition.
Reply to the application has been filed.
Learned Senior Counsel for the petitioners has submitted that the reason as to why the revision could not be filed within the period of limitation is that the petitioners were under the belief that limitation starts as from the date when the certified copy of the order is made available to the party concerned.
On the other hand, learned counsel for the non- applicant/respondent submitted that the explanation given in the application is totally baseless for the reason that the petitioners applied for the copy of the order after the expiry of limitation and further, as ignorance of law is no excuse, the averments made in the application cannot be used by the petitioners for condonation of inordinate delay. No other point was urged.
Having heard learned counsel for the parties and having perused the application as also the reply, we are not
convinced with the explanation, which has been given in the application, more so for the reason that it is mentioned in the order under challenge itself that copy of the order be supplied to the applicants therein, i.e., the present petitioners, free of cost.
However, in light of the fact that the petition filed by the present applicants under Section 125 of the Cr.P.C. for grant of maintenance has been rejected, we are of the considered view that it would be in the interest of justice, in case, the applicants are given an opportunity to agitate the said order before this Court on merits.
Accordingly, in light of the above reasoning, this application is allowed. Delay in filing the Revision Petition is condoned. Application stands disposed of.
