JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused is before this Court calling in question proceedings in S.C.No.571/2026, pending before the XLV City Civil and Sessions Judge, Bengaluru, for the offences under Sections 75, 76, 115(2), 351(2) and 352 of the BNS. - 3 - HC-KAR NC: 2026:KHC:29838 CRL.P No. 8245 of 2026 2. Learned counsel for the petitioner and respondent No.2 in unison would submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed an interlocutory compromise application under Section 528 of the BNSS, 2023 along with a joint verifying affidavit before this Court, seeking permission to compound the offences. 3. The interlocutory compromise application reads as follows: “1.XXXX 2. XXXX 3. XXXX 4. It is submitted that the Petitioner and Respondent No. 2 on the advice of the elders and well wishers and friends have, in their mutual interest, decided to the amicable resolve and settle the outstanding claims and disputes arising out of the all dealings between them weather personal or business in the furtherance. Respondent No.2 is not claiming anything from the Petitioner now or in future. 5. In light of the compromise all claims made by the Respondent No.2 in the complaint and FIR forming the subject matter of this Petition and in all proceedings arising there from stand unconditionally withdrawn and that no claims remaining against the Petitioner. - 4 - HC-KAR NC: 2026:KHC:29838 CRL.P No. 8245 of 2026 Wherefore, the Petitioner and Respondent No.2 most humbly prays this Hon'ble court be pleased to quash the entire proceedings in Crime No. 356/2025 (S C No. 571/2026) registered by Respondent No.1 Police against the Petitioner herein for offences punishable under Sections 75, 76, 115(2), 351(2), 352 of Bharatiya Nyaya Samhitha, 2023. Pending on the file of Hon'ble 45th Additional City Civil and Session Judge, Bengaluru City (CCH.46) Bengaluru in the ends of Justice.” In the light of the afore-quoted application of the parties, I deem it appropriate to terminate the proceedings against the petitioner, as the dispute and the allegations are between the individuals and not against the State. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. (b) The proceedings in S.C.No.571/2026 (arising out of Crime No.356/2025), pending before the XLV City Civil and Sessions Judge, Bengaluru, qua the petitioner, stands quashed.
