Rakesh Kainthla, Judge The petitioner has filed the present petition for quashing of FIR No. 01 of 2026, dated 02.02.2026, registered for the commission of an offence punishable under Section 137(2) of Bhartiya Nyaya Sanhita (BNS), 2023 at Women Police Station Bilaspur, District Bilaspur, H.P. and consequential proceedings arising out of the said F.I.R. based on the compromise. 2 2026:HHC:41116 2. It has been asserted that the matter has been compromise between the petitioner and the mother natural guardian of the victim. The victim does not want to proceed further with the matter after the compromise. Hence, the present petition. 3. The statement of the mother of the victim, namely, Indira Devi was recorded on 31.07.2026, in which she stated that matter has been compromised with the petitioner voluntarily without any influence from any person and she has no objection for quashing the F.I.R based on a compromise between the parties 4. Heard. 5. Section 137(2) of BNS corresponds to Section 363 of the IPC. This court has quashed the FIR registered for the commission of an offence punishable under Section 363 of IPC inter alia in Jitender Kumar vs State of H.P., Cr.MMO No. 234 of 2024, decided on 14.06.2024 and Bhupinder Kumar vs. State of H.P. & others Cr.MMO No. 505 of 2022, decided on 1.09.2022, based on compromise and these judgments are binding on this Court. 3 2026:HHC:41116 7. Consequently, the present petition is allowed, and the FIR No. 01 of 2026, dated 02.02.2026, registered for the commission of an offence punishable under Section 137(2) of BNS at Women Police Station Bilaspur, District Bilaspur, H.P. and consequential proceedings arising out of F.I.R. are quashed. 8. Petition stands disposed of in the above terms, so also pending applications, if any. 9. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certified copy but, if required, may verify passing of the order from Website of the High Court.
