ORDER ON BOARD 30/06/2026
1. This MCC is filed seeking modification of typographical error in the
order dated 07.07.2025 passed in MAC No. 1785/2019.
2.
Learned counsel for applicant submits that this Court while deciding the appeal seeking enhancement of award dated 08.02.2019 passed by Claims Tribunal has enhanced the amount of compensation on certain heads but has not enhanced the amount of compensation awarded under medical expenses. However, in para-16 it is erroneously PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA
2 / 3 mentioned as Rs. 52150 instead of Rs. 4000 due to typographical error and accordingly total amount of compensation awarded is also enhanced and therefore appropriate correction be made in the order dated 07.07.2025.
3.
Learned counsel for Respondent No. 1/ claimant does not oppose the submission of learned counsel for applicant.
4. Upon considering the discussion made in the order dated 07.07.2025 of which modification/ correction is sought it appears that due to typographical error in para-16 against medical expenses, compensation is mentioned as Rs. 52150 instead of Rs. 4000 as awarded by the Claims Tribunal in para-33 in its award dated
08.02.2019.
5. On due consideration of the submission made by learned counsel for the parties as also considering the record of MAC No. 1785/2019 where the Claims Tribunal has awarded a sum of Rs. 4000 towards medical expenses and further in claim application No. 86/14 filed by Deepak Mangode, the award passed in Motor Accident Claim Case No. 87/14 between Raj @ Bhaktraj Bariya vs. Jagjit Singh, is enclosed, it is apparent that due to typographical error, medical expenses is mentioned as Rs. 52150 instead of Rs. 4000.
6. Accordingly, the amount towards medical expenses mentioned in para- 16 of the order dated 07.07.2025, subject matter of this application, is
directed to be read as Rs. 4000 instead of Rs. 52150 and further the total amount of compensation be read as Rs. 2,64,680 instead of Rs. 3,12,830. It is ordered accordingly. It is further clarified that in para-17 it is to be read as “claimant/ appellant is held entitled for a total
3 / 3 compensation of Rs. 2,64,680 in place of Rs. 2,34,150”. Other parts of the award shall remain intact.
7. Accordingly, this MCC is allowed and the order dated 07.07.2025 passed in MAC No. 1785/2019 is modified in the above terms. Registry is directed that this order be also made part of the record of order passed in MAC No. 1785 of 2019. Sd/- (Parth Prateem Sahu) pwn
