CORAM: HON'BLE MR. JUSTICE PARMOD GOYAL Present: Mr. Rupender Singh Rana, Advocate for petitioner. Mr. Rajesh K. Sheoran, Addl. P.P., U.T., Chandigarh. *** PARMOD GOYAL, J. (ORAL) Present petition has been filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 by petitioner for grant of anticipatory bail in FIR No.0074 dated 26.05.2026 registered under Sections 326(g), 124(1) and 105 of Bharatiya Nyaya Sanhita, 2023 at Police Station South Sector 34, Chandigarh.
2. Notice of motion.
3. On advance notice, Mr. Rajesh K. Sheoran, Addl. P.P., U.T., Chandigarh, who is present in Court, accepts notice on behalf of respondent.
4. It is the case of petitioner that he is running a departmental store and is a victim of unfortunate occurrence and had sustained serious burn injuries in the incident wherein he has been shown to be an accused. It is asserted that petitioner had suffered severe burn injuries. He was initially taken to Government Medical College and Hospital, Sector 32, Chandigarh and presently undergoing treatment at J.P. Hospital, Zirakpur. It is further SUNIL CHANDER 2026.06.22 17:36 I attest to the accuracy and integrity of this document
CRM-M-34291-2026 -2- asserted that petitioner is incapable of appending signatures on account of his injuries and has been falsely implicated. It is also asserted that petitioner is not involved in the said incident and has no concern with the case.
5.
Learned counsel for State has opposed the bail application. It is asserted that the occurrence had taken place as petitioner was re-filling gas cylinders illegally in the room possessed by him. It is the case of prosecution that large number of cylinders were recovered from the room in possession of petitioner. Therefore, keeping in view seriousness and nature of offence, custodial interrogation of petitioner is necessary.
6. On consideration, I find no reasons for grant of anticipatory bail in the facts and circumstances of the present case. The offence was of serious nature resulting in explosion due to illegal activities of re-filling of cylinders causing damage to the property as well as injuries and death of three persons namely Munna, Mahesh and Gopi, who were residing in adjoining room in the same building. It is also noted that as many as 18 cylinders and 06 nozzles were recovered from the spot i.e. room of the petitioner.
7. In view of above, there is no merit in present petition, hence same is dismissed.
