Criminal Miscellaneous Bail Application No. 3364/2026 Akash @ Parra S/o Shri Bhup Singh, Aged About 24 Years, R/o Dahmi, Police Station Behror District Kotputli-Behror (Raj.) (At Present Lodged In District Jail, Alwar). ----Petitioner Versus State of Rajasthan, through PP ----Respondent For Petitioner(s) : Mr. Ashvin Garg For Respondent(s) : Mr. Shree Ram Dhakad, Public Prosecutor HON'BLE MR. JUSTICE GANESH RAM MEENA Order 18/04/2026 1. The instant bail application has been filed under Section 483 of BNSS, 2023 on behalf of accused-petitioner in connection with FIR No.293/2025 registered at Police Station Bahror, District Kotputli-Behror for the offences under Section 111(2) of BNS, 2023 and Section 3/25 & 25(6) Arms Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has been implicated in this case merely because while the vehicle was stopped by the Police, he was found to be present in that vehicle. Learned counsel further submits that the Police has received a secret information that certain persons were preparing for committing a crime and thereafter, the Police in a secret manner captured the video at the time when they were preparing for committing the said crime. Learned counsel further submits that in the description of the video clip, there is no [2026:RJ-JP:16414] (2 of 3) [CRLMB-3364/2026] reference of the present accused-petitioner and he was not found to be there on the spot. Learned counsel also submits that a mobile set of the co-accused, namely, Prashnadeep @ Parra was recovered and from it a video clip was recovered however, in that video clip also petitioner's involvement is not found. 3. Learned counsel further submits that the accused-petitioner is in custody since 04.08.2025 and the Police after completion of investigation has already submitted charge-sheet in the matter. 4. Learned Public Prosecutor vehemently opposed the bail application and submits that the accused-petitioner was found alongwith other co-accused who were said to be preparing for committing the crime. He also submits that several other cases are pending against the accused-petitioner, therefore, he may not be released on bail. 5. Considered the submissions made by learned counsel for the petitioner as well as learned Public Prosecutor and also perused the material made available on record. 6. Having regard to the submissions made by counsel for the petitioner and more particularly the fact that in the description video clip of the accused captured by the Police itself as regards preparation of crime by them seems to be no involvement of the present accused-petitioner and so also the fact that the charge- sheet has already been filed and the accused-petitioner is in custody since 04.08.2025, this Court without expressing any opinion on the merits or demerits of the case deems just and proper to enlarge the accused-petitioner on bail. [2026:RJ-JP:16414] (3 of 3) [CRLMB-3364/2026] 7. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner named above shall be enlarged on bail provided, he furnishes a personal bond in the sum of Rs.1,00,000/- together with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
