The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No. 69/2026, registered at Police Station Lailunga Dist.- Raigarh (C.G.) for alleged commission of offence punishable under Section 20(B) and 29 of Narcotic Drugs and Psychotropic Substance Act.

As per the prosecution story, in brief, Sub-Inspector Rajesh Darshan received credible information that two persons were transporting an illegal contraband substance, namely ganja (cannabis), from Odisha towards Village Pakargaon, Lailunga, in a chocolate-coloured Maruti Suzuki Swift car bearing Registration No. CG-13-UG-9683. 2 Pakargaon, and attempted to intercept the vehicle. However, upon noticing the police party, the accused persons turned the vehicle towards Village Potra in an attempt to evade apprehension. Thereafter, the vehicle was intercepted, and two persons were found inside. The driver disclosed his name as Shravan Kumar Nishad, while the co-occupant identified himself as Mahendra Pratap Chauhan. During the search of the vehicle, ganja (cannabis) weighing approximately 10.048 kg was recovered. Further, another white plastic bag containing 8.985 kg of ganja and an additional bag containing 10.082 kg of ganja were also recovered and seized from the vehicle.

Learned counsel for the applicant submits that the applicant is innocent, has been falsely implicated in the present case, and has not committed any offence. She further submits that the applicant has been implicated solely on the basis of the memorandum statement of the co-accused, from whose possession the alleged contraband was recovered. It is contended that there is no other material connecting the applicant with the alleged offence. Therefore, learned counsel prays for the grant of anticipatory bail to the applicant.

On the other hand, learned State counsel opposes the application for grant of anticipatory bail and submits that, during the course of investigation, it has come to light that the applicant was involved in the purchase and sale of the contraband. It is further submitted that the applicant has been absconding and is evading arrest. Therefore, it is contended that the applicant is not entitled to the grant of anticipatory bail.
5. Recently the Supreme Court in the matter of Anarul SK v. The State of West Bengal {SLP (Crl.) No(s). 12621/2024 has observed that the grant of anticipatory bail in cases involving Narcotic Drugs and Psychotropic Substances (NDPS) is a very serious issue.

6. In the light of observation made by the Supreme Court in Anarul SK (supra), I do not find any good ground to entertain this anticipatory bail application. Accordingly, the present anticipatory bail application is dismissed. Sd/-
