JUSTICE D K SINGH) For the reasons stated in the application I.A.1/2025, the same is allowed and the delay in filing the appeal is condoned. 2. In the connected appeal in W.A.No.1449/2025, by order dated 29.04.2026, we have passed the following order: - 3 - HC-KAR NC: 2026:KHC:31754-DB WA No. 1451 of 2025 “The learned counsel for respondent submits that this Court may dispose of the appeal by permitting the respondent to file objections to the show cause notice dated 06.10.2024, which has been set aside by the learned Single Judge in the impugned judgment and order passed in W.P.No.22247/2023. 2. In view of the said stand taken by the learned counsel for respondent, we allow this Writ appeal, by setting aside the impugned judgment and order dated 16.07.2024. However, the petitioner is permitted to file the objections to the Notice dated 06.10.2024, issued in respect of revenue proceedings in dispute No.R.U.C(A):96/2023 dated 06.10.2024. The petitioner should file the objections to the Notice within a period of one month and the proceedings should be concluded by the respondent No.2-Assistant Commissioner, within a period of one month thereafter. 3. With the aforesaid direction, Writ Appeal stands allowed.” 3. The present writ appeal is in respect of conducting phodi and durasth. The learned AGA submits that the writ appeal can be disposed of with a direction that phodi and durasth may be carried out subject to the order passed by the Assistant Commissioner as directed by us in the judgment dated 29.04.2026 passed in W.A.No.1449/2025. 4. Learned counsel for the respondents is also in agreement for passing such an order in the present appeal. We therefore, dispose of the present appeal with a - 4 - HC-KAR NC: 2026:KHC:31754-DB WA No. 1451 of 2025 direction to the respondents to carry out phodi and durasth which would be subject to the order being passed by the Assistant Commissioner as directed in the order dated 29.04.2026 in W.P.No.1449/2025. 5.
