1. Affidavit of service filed in Court today be kept with the records.
2. The petitioner is aggrieved by the inter district transfer order dated July 5, 2022 issued in his favour.
3. Specific submission of the petitioner is that he is a teacher of a Bengali medium school. The transferee school is a Hindi medium school. Due to the mismatch of the medium of the school, the transferee school did not allow the petitioner to join.
4. The petitioner applied before the Secretary of the West Bengal Board of Primary Education requesting correction in the medium of the school and to transfer him to a Bengali medium school. The said application is pending consideration for a considerable period of time.
5. Without entering into the merit of the application, as it appears that the petitioner is
2 teaching in a Bengali medium school, accordingly, he ought to be transferred to a Bengali medium school.
6. The Secretary is directed to take a decision on the petitioner’s prayer strictly in accordance with the prevailing rules, at the earliest, but positively within a period of twelve weeks from the date of communication of this order.
7. The matching vacancies available for transfer shall be intimated to the petitioner so that he can choose the school accordingly.
8. If no matching vacancy is available, the same shall also be intimated to the petitioner.
9. Writ petition stands disposed.
10. Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Amrita Sinha, J.)
