This revisional application seeks expeditious disposal of a partition suit being Title Suit No. 1628 of 2023 pending before the learned Additional Civil Judge (Junior Division), 1st Court at Alipore, South 24-Parganas. 2. Learned Advocate appearing for the petitioner submits that despite the said suit having been filed in the year 2023, the same has seen little progress. It is further submitted that an application under Order 1 Rule 10(2) of the Code of Civil Procedure, 1908 filed on February 13, 2025 is also pending adjudication. 3. In view of the nature of the order proposed to be passed by this Court, direction for prior service of notice along with a copy of the revisional application on the opposite parties is not being made, however, the petitioner shall remain obliged to serve a copy of the revisional application along with a copy of this order upon the opposite parties within a week from date. 2 4. Having heard the learned Advocate appearing for the petitioner and having perused the material- on-record, this revisional application is disposed of by requesting the learned Additional Civil Judge (Junior Division), 1st Court at Alipore, South 24- Parganas to dispose of the application under Order 1 Rule 10(2) of the Code as expeditiously as possible and preferably within a period of one month from the next date fixed without granting any unnecessary adjournment to either of the parties. The learned Trial Court is also requested to dispose of the suit thereafter, as expeditiously as the business of the Court would permit. 5. C.O. 889 of 2026 stands disposed of. No costs. 6. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
