Learned counsel appearing for respective respondents submit that petitioner in this writ petition has sought main relief in para 10.4 of writ petition seeking quashment of Notification dated 31.08.2020 (Annexure P-1). They submit that extension which is granted by impugned Notification is for the year 2020-2021 only. It is also specifically mentioned in the Notification that no further extension shall be granted. As the period mentioned in the Notification has already expired, writ petition has rendered infructuous. 2. Learned counsel for the petitioner submits that he is not disputing the fact that Notification is issued only for one year and which has already come to an end. He, however, submits that after disposal 3 / 3 of this writ petition, petitioner apprehends that respondent – Indian Nursing Council will continue to issue such Notification further. 3. Heard learned counsel for the parties. 4. The Notification which is under challenge is extracted below for ready reference: “ NOTIFICATION Sub:- Notification regarding Renewal of Suitability. Extension of date for submission of online Renewal/Validity applications for the year 2020-2021 is extended up to 15 th Sept, 2020 . No further extension shall be granted. Further, the institutes may note that, the online applications for renewal will be processed on first-in- first-out (FIFO) basis i.e those who apply first, their application will be processed first.” 5. From the contents of Notification, it is apparent that it was issued only with respect to Year 2020-21 with clarification that no further extension shall be granted. 6. Undisputedly, the period of Notification has already come to an end and, therefore, I am of the view that writ petition has rendered infructuous, accordingly, it is dismissed. However, it is left open for the petitioner to challenge the subsequent action if it feels that any Notification is issued in contravention of any of the provision of law.
