02/ 29.08.2026: Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Kanke P.S. Case No. 166 of 2024, registered under sections 147, 148, 149, 341, 323, 307, 504, 506, 385, 387 of I.P.C, pending in the Court of learned Judicial Magistrate-XIII, Ranchi.

Learned counsel for the petitioners submits that allegations are made that the informant on an agreement was developing the land and these petitioners have gone there and assaulted. He next submits that the land is belonging to the petitioners in the light of Annexure-2 series which are rent receipts of the said plot. He next submits that the alleged occurrence is said to be dated 16.06.2024 wherein the F.I.R has been lodged on 19.06.2024. He next submits that petitioners have got no criminal antecedent which is disclosed in para 10 of the petition and three of the co-accused persons have been granted anticipatory bail in A.B.A. No. 4599 of 2026. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations of assault are there and there is specific allegation of assault by knife against the petitioner no.1 namely, Abid Qureshi and in view of that anticipatory bail may kindly be rejected.

On perusal of F.I.R. it transpires that there is direct allegation of assault by knife against the petitioner no.1 and in view of that the fact of the case of the petitioner no.1 is not coming under the fact of the case of three co-accused persons who have been granted anticipatory bail in the aforesaid

A.B.A. In view of that I am not inclined to grant anticipatory bail to the petitioner no.1. Accordingly, the prayer of anticipatory bail on behalf of petitioner no.1 namely, Abid Qureshi, is hereby rejected.

So far prayer of bail on behalf of petitioner no. 2 is concerned, in identical situation three of the co-accused persons have been granted anticipatory bail in the aforesaid A.B.A and petitioner no.2 has got no criminal antecedent, I am inclined to grant anticipatory bail to the petitioner 2. Accordingly, the petitioner no. 2 namely, Sarataj Qureshi @ Sarataj Kuraishi is
directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner no.2 shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate-XIII, Ranchi, in connection with Kanke P.S. Case No. 166 of 2024, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
