Petitioner has claimed following substantive relief in this writ petition:-
“i) That a writ in the nature of Mandamus or any other appropriate writ, order or direction may kindly be issued directing the respondents to release other retiral benefits to the Petitioner like Gratuity, DCRG, Leave Encashment etc. along with interest @ 9% p.a. w.e.f. 1.1.1993 to 31.05.2023.”

Respondents have placed on record office instructions dated 21.09.2026 to the effect that the petitioner had been dismissed from service on 12.11.1992.

2 Upon dismissal of the petitioner, his past service was forfeited under Rule 24 of the Central Civil Services (Pension) Rules, 1972. It has also come in the office instructions that compassionate allowance under Rule 41 of the CCS (Pension) Rules was sanctioned in favour of the petitioner w.e.f. 07.06.2023 vide office
order dated
18.05.2024.

Learned counsel for the petitioner submits that in view of the facts outlined in the office instructions about petitioner having been dismissed from service on 12.11.1992, this writ petition seeking retiral benefits be closed, however, liberty be reserved to the petitioner to seek appropriate remedy for claiming compassionate allowance from the due date.
Accordingly, granting such liberty, the present writ petition to stand disposed of. Pending miscellaneous application(s), if any, also stand disposed of.
