The instant review petition has been submitted for recalling the order dated 21.07.2023 passed by this Court while deciding S.B. Civil Writ Petition No. 10571/2007. Counsel for the petitioner submits that when the case was listed before this Court on 21.07.2023, he made a submission before this Court that the controversy involved in the aforesaid petition was decided by the Co-ordinate Bench of this Court, at Principal Seat, Jodhpur in the case of Deva Ram Vs. State of Rajasthan and Ors. while deciding (S.B. Civil Writ Petition No. 96/2010) on 13.03.2015. Counsel submits that considering the factual aspect of the matter, this Court disposed of the writ petition submitted by the petitioner in reference to the order dated 01.12.2015 whereby Deva Ram was granted minimum of pay scale as admissible to AVVNL employees i.e. Rs. 5250+ 1750 total Rs. 7000/- w.e.f. 13.03.2015, however, the benefit of regularization was not granted to him. Counsel submits that considering the above factual aspect of the matter, a direction was issued to the respondents to grant the aforesaid benefit of regularization to the petitioner and pass necessary orders in compliance of the order. Counsel submits that subsequently, a fact came into the notice of the petitioner that in fact no such benefit was granted to Deva Ram by the respondents, hence he approached the Principal Seat of this Court again in the year 2016 by way of filing S.B. Civil Writ Petition No. 581/2016 and in para 21 of the said petition he has narrated the facts of not granting the benefit of regularization to him. Counsel submits that under these circumstances, the order dated 21.07.2023 is liable to be recalled. 3. Per contra, learned counsel for the respondents opposed the arguments raided by counsel for the petitioner and submits that after attaining the age of superannuation, the petitioner is not [2026:RJ-JP:16457] (3 of 3) [WRW-151/2024] entitled to get either the benefit of regularization or the benefit of minimum pay scale, hence interference of this Court is not warranted and the present review petition is liable to be rejected. 4. Heard and considered the submissions made at Bar and perused the material available on record. 5. Considering the arguments raised by counsel for the petitioner and looking to the fact that S.B. Civil Writ Petition No. 10571/2007 submitted by the petitioner was disposed of on the basis of the order dated 01.12.2015 passed by the respondents in favour of the aforesaid Deva Ram, it appears that the benefit of regularization was not extended to the said Deva Ram, hence he approached the principal seat of this Court by way of filing S.B. Criminal Writ Petition No. 581/2016 and the same is still pending for its adjudication on its merit. 6. Considering the above facts, the present review petition stands allowed and the order dated 21.07.2023 is recalled and the S.B. Civil Writ Petition No. 10571/2007 is restored to its original number. 7. Stay application and all pending application(s), if any, also stand disposed of. (ANOOP KUMAR DHAND),J Ashu/39
