The Writ Petition has been filed for the following relief:
“…to issue an appropriate Writ or order or direction more particularly writ of Mandamus, declaring the action of respondent police in not disposing the complaint of the petitioner, dated 16.03.2026 in accordance with law, without conducting any investigation or giving any opportunity to submit evidence and failed to register FIR despite the said complaint or taken any action against the unofficial Respondent no.5 to 7 as illegal, arbitrary and against the principles of natural justice and also in violation of Article 14, 19, 21 and 300A of Constitution of India and also in contravention of Apex court Judgment in Lalita Kumari Vs Government of J.P.,(2014) 2 SCC 1 and consequently direct the respondent Police to register the complaint of the petitioner and take appropriate action in the matter in accordance with law …”
2. Heard the learned counsel for Petitioner and learned Assistant Government Pleader. 3
3. Ms. Ayesha Azma S, learned counsel for the Petitioner, submits that the two children of the Petitioner were kidnapped by the unofficial Respondents prior to filing of the Writ Petition.
Subsequently, a boy aged about three years, Yaswin, was returned to the Petitioner, but the daughter, Gowthami, aged six years, continues to remain with Respondent Nos.5 and 6. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the Petitioner has got an alternative efficacious remedy of filing an appropriate petition before the competent civil court under the Guardians and Wards Act for custody of the girl child from Respondent Nos.5 and 6. 5. Indeed, the Petitioner, being a hapless mother, has got an efficacious remedy under the Guardians and Wards Act to file an appropriate application before the learned Jurisdictional Principal District Judge or Family Court for custody of the girl child. It appears that the Petitioner has not invoked such jurisdiction. 6. Having regard to the facts and circumstances of the case, the Writ Petition is disposed of, requiring the Petitioner to file an appropriate petition before the learned Jurisdictional Principal District Judge or Family Court seeking custody of the girl child, Gowthami, aged about six years, from Respondent Nos.5 and 6. On filing such petition, the competent court shall dispose of the same expeditiously. 4
