Accused Nos.3 and 4 in Crime No.78/2026 registered by Amruthahally Police Station, Bengaluru City, for the offences punishable under Sections 61, 64, 70(1), 351(2) read with Section 3(5) BNS, 2023, are before this Court in these petitions filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.78/2026 was registered by Amruthahally Police Station, Bengaluru City, initially for the offences punishable under Sections 64, 70(1), 351(2) read with Section 3(5) of BNS, 2023, against Diksan Sandra and another based on the first information dated 22.02.2026 received from the victim girl aged about 22 years. In the said case, petitioners herein were arrested on 28.02.2026 and arraigned as accused Nos.3 and 4 in the remand application. After completing investigation, charge sheet has been filed against five persons and petitioners are arrayed as accused Nos.3 and 4 in the charge sheet. Their bail application filed before the jurisdictional Sessions Court was rejected. Learned counsel for the petitioners submits that allegation as against accused No.5 and the petitioners herein is similar in the charge sheet. Only offence punishable under Sections 61, read with Section 3(5) of BNS, 2023, has been invoked insofar as the petitioners are concerned on the allegation that they had facilitated accused Nos.1 and 2 to commit the alleged crime punishable under Sections 64 and 70(1) of BNS, 2023. 5. This Court in Crl.P.No.6632/2026 has granted regular bail to accused No.5 as against whom similar allegations are found. In paragraph No.5 of the said order, it is observed as follows:- "5. Perusal of the charge sheet would go to show that the allegation of committing assault on the victim girl is found only as against accused nos.1 & 2. So far as petitioner who is arrayed as accused no.5 in the charge sheet, the police have invoked the offence punishable under Section 61 read with 3(5) of BNS, 2023. Learned Counsel for the petitioner has submitted that petitioner has no other criminal antecedents. Even otherwise, considering the allegation found against the petitioner in the charge sheet which is now filed, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively…" - 5 - HC-KAR NC: 2026:KHC:31176 CRL.P No. 6176 of 2026 C/W CRL.P No. 6934 of 2026 6. Under the circumstances, I am of the opinion that the prayer made by the petitioners for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:- 6. The petitions are allowed. The petitioners are directed to be enlarged on bail in Crime No.78/2026 registered by Amruthahally Police Station, Bengaluru City, for the offences punishable under Sections 61, 64, 70(1), 351(2) read with 3(5) of BNS, 2023, subject to the following conditions: a) Petitioners shall execute personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; - 6 - HC-KAR NC: 2026:KHC:31176 CRL.P No. 6176 of 2026 C/W CRL.P No. 6934 of 2026 e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
