ORAL JUDGMENT
(PER: HON'BLE MR. JUSTICE VIJAYKUMAR A. PATIL)
This Contempt of Court Case is filed alleging willful disobedience of the Order dated 06.04.2023 passed by the learned Single Judge in Writ Petition No.7431/2023 (LA- BDA). The learned Single Judge of this Court has directed the respondents to consider the petitioner's representation within a period of three months and till consideration of the said representation, there shall be no interference with the subject property.

Learned counsel for the complainant submits that the authority has now considered the representation and rejected the same vide endorsement dated
22.04.2024. However, on 19.10.2023, the accused has interfered with the possession and demolition of structure. Hence, he submits that there is a willful disobedience.
3. Sri. Murugesh V. Charati, learned counsel for accused No.1 to 3 submits that there is no willful disobedience as the accused has recorded and considered

the representation of the complainant and issued an endorsement stating that he is not eligible for allotment of an alternative site and he seeks to close the Contempt of Court Case.
4. We have heard the arguments and perused the direction of the learned Single Judge and the compliance affidavit filed by the accused. It is not in dispute that the representation of the complainant is considered by the accused and the same was rejected by an endorsement dated 22.04.2024. Insofar as the contention of the complainant that the authorities have interfered with the subject property before
consideration of the representation, in our considered view, the said fact has been disputed by the accused, hence, the same cannot be gone into in this present proceeding. It is open for the complainant to workout remedies in accordance with law.
5. In view of the aforesaid submission and endorsement, the Contempt of Court case is closed,

liberty is reserved to seek compensation to acquired land as well as the structure, if any in accordance with law.
