The present appeal under Section 13(1) (ia) of the Hindu Marriage Act, 1955, has been filed impugning the
order dated 10.02.2026 passed by the II Additional Senior Civil Judge, Bengaluru Rural District, Bengaluru in MC.No.190/2025 filed by the appellant/wife.
2. Seeking a decree of divorce for dissolution of marriage under Section 13(1)(ia). Besides seeking a decree of divorce, the appellant has also sought permanent alimony of Rs.1,50,00,000/- from the respondent-husband. The respondent-husband had not contested the petition filed by the appellant-wife and therefore, decree of divorce has been granted by the impugned order passed by the Family Court under Section 13(1)(ia) of the Hindu Marriage Act, 1955. The prayer for

granting permanent alimony of Rs.1,50,00,000/- has been rejected by the Family Court on the ground that the appellant-wife did not furnish any documents or evidence in support of her claim for permanent alimony of Rs.1,50,00,000/-. She has not adduced any evidence regarding the income of the respondent-husband. As the appellant-wife has failed to adduce evidence to bring on record the income of the respondent-husband, her claim for permanent alimony for Rs.1,50,00,000/- has been rejected.
3. The appellant-wife is well qualified and well placed. She is working in a high position in IT sector and drawing good salary. So far as two children are concerned, the husband is paying Rs.30,000/- per month for their maintenance.
4. As the appellant has failed to produce any cogent and credible evidence claiming the permanent alimony of Rs.1,50,00,000/- and it is undisputed that she is well placed and drawing good salary.

We find no reason to interfere with the impugned
order passed by the Family Court and therefore, we dismiss this appeal. However, it would be open to the appellant to move an appropriate application at an appropriate stage for modifying the order of maintenance, if it is so required in the facts and circumstances of the case. With the aforesaid liberty we dismiss this appeal as we find no merit in the case.
