3. LEGAL AID The Court made the following:
ORDER:
The instant petition under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed seeking to grant anticipatory bail to the Petitioner / Accused, in connection with Crime No.249 of 2025 on the file of Kanchikacherla Police Station, NTR Commissionerate, which is registered for
2
the offences under Sections 376(2)(n), 380, 354-C, 506 and 509 of Indian Penal Code.
2. The case of the prosecution, in brief, is that the Accused, who is known to the family of the victim, allegedly stole gold ornaments weighing about 10 sovereigns from her house in February 2024. It is further alleged that on the pretext of returning the stolen gold and by threatening to defame her through photos and videos, the Accused repeatedly subjected the victim to sexual assault when her husband was not at home. He is also alleged to have criminally intimidated to kill her and her husband and abused her over phone.
3. Heard Sri Thandava Yogesh, learned counsel for the Petitioner and Sri K.Sandeep, learned Assistant Public Prosecutor for State/Respondent.
4.
Learned counsel for the Petitioner would submit that, the Petitioner and the victim have been acquainted since 2017 and it turned into a close relationship. It is further submitted that there was a consensual intimate relationship between them. Learned counsel would further submit that no offence has been committed by the Petitioner as alleged. The allegations leveled against the Petitioner are false. It is further submitted that the Petitioner is ready to furnish sureties to the satisfaction of the Court. Hence, prayed to grant anticipatory bail to the Petitioner.
5. Learned Assistant Public Prosecutor would submit that there are specific allegations against the Petitioner in the commission of the alleged offences. It is further submitted that the investigation is not yet completed.
3
It is not a fit case for grant of anticipatory bail to the Petitioner at this stage. Hence, prayed for dismissal of the petition.
6. A bare perusal of the material on record would disclose that the allegations made against the Petitioner are grave in nature. The complaint discloses specific accusations of theft, followed by repeated sexual assault by exploiting the victim’s vulnerability through threats of defamation and harm. The contention of the Petitioner that the relationship was consensual is a matter to be examined during the course of investigation and trial.
7. Considering the seriousness of the accusations, the specific overt acts attributed to the Petitioner, and the fact that the investigation is still pending, this Court is of the view that grant of anticipatory bail may adversely affect the investigation. In that view, this Court does not find any valid grounds to exercise the discretionary relief of anticipatory bail in favour of the Petitioner.
8. Accordingly, the Criminal Petition is dismissed.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
