For Petitioner(s): Mr.VS.Dixt For Respondent(s): Mr.U.Baranidharan, SGP https://www.mhc.tn.gov.in/judis WP No. 8472 of 2026 __________ Page2 of 4 ORDER This writ petition has been filed seeking for a direction to the respondents to remove the impugned encumbrances found in the Encumbrance Certificate (EC) based on the order passed by this Court in W.P..No.7842 of 2021, dated 15.12.2021. 2. According to the petitioner, by order dated 15.12.2021 passed in W.P.No.7842 of 2021, the impugned encumbrances as disclosed in the affidavit filed in support of this writ petition were quashed. The petitioner had given a representation to the respondents on 19.12.2024 requesting them to remove the encumbrances in terms of the order passed by this Court in W.P..No.7842 of 2021, dated 15.12.2021. Since the said representation has not been considered till date, the petitioner has filed this writ petition. 3. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice on behalf of the respondents. At the outset, he would submit that the respondents do not have power to remove the entries found in the EC, and the respondents can only neutralize the same by making relevant entries in their records. 4. No prejudice will be caused to the respondents if the petitioner’s representation dated 19.12.2024 is considered on merits and in accordance with https://www.mhc.tn.gov.in/judis WP No. 8472 of 2026 __________ Page3 of 4 law within a time frame to be fixed by this Court. Accordingly, this Court directs the second respondent to pass final orders, on merits and in accordance with law, on the petitioner’s representation dated 19.12.2024 seeking for removal of the encumbrances found in the EC based on the order passed by this Court in W.P..No.7842 of 2021, dated 15.12.2021, after giving due consideration to the supporting documents filed by the petitioner, within a period of 12 weeks from the date of receipt of a copy of this order. In case if the second respondent comes to the conclusion that the entries reflected in the EC have to be removed, and if the second respondent does not have the power to remove the same, the second respondent shall at least neutralise the same by making appropriate entries in their records.
