01. Through the medium of instant Writ Petition filed under Article 226 of the Constitution of India, the petitioner seeks the following reliefs:- (i) Writ of mandamus commanding and directing the respondents to release an amount to Rs. 18,120/- along with interest @ 24% per annum pending towards the respondents with regard to the work allotted to the petitioner for construction of T/Road Main road to Saral Mohalla in Pyt-Thuroo A2 Block Thuroo under Capex Budget (PRI) District Reasi pursuant to e-NIT No. 121 REW Reasi of 2021 dated 18.10.2021. (ii) Commanding and directing the respondents to release an amount to Rs.1,54,200/- along with interest @24% per annum pending towards the respondents with regard to the work allotted to the petitioner for construction of T/Road Barrian to Kakdailoo in Pyt- Thuroo A2 Block Thuroo under Capex Budget (PRI) District Reasi pursuant to e-Nit No. 121 REW Reasi of 2021 dated 18.10.2021. (iii) Commanding and directing the respondents to realise the amount of security deposit alongwith interest in favour of the petitioner.
02. The case projected by the petitioner in the present writ petition is that he participated in e-NIT No. 121 REW Reasi of 2021 dated 18.10.2021 for Serial No. 183

construction of various works and being the lowest bidder, was allotted the following works:- (a) Construction of T/Road Main Road to Saral Mohalla in Pyt-Thuroo A2 Block Thuroo under Capex Budget (PRI), District Reasi pursuant to e-Nit No. 121 REW Reasi of 2021 dated 18.10.2021 and (b) Construction of T/Road Barrian to Kakdailoo in Pyt- Thuroo A2 Block Thuroo under Capex Budget (PRI), District Reasi pursuant to e-Nit No. 121 REW Reasi of 2021 dated 18.10.2021.
03. It is submitted that the allotment order with regard to construction of T/Road Main Road to Saral Mohalla in Pyt-Thuroo A2 Block Thuroo under Capex Budget (PRI), District Reasi was issued with regard to the allotted amount of Rs.1,98,120/-, vide allotment
order No. No. EE/REWR/T/2021 22/17 dated 03.01.2022, whereas, the allotment
order with regard to the construction of T/Road Barrian to Kakdailoo in Pyt-Thuroo A2 Block Thuroo under Capex Budget (PRI), District Reasi was issued with regard to the allotted amount of Rs.2,03,200/- vide allotment order No. EE/REWR/T/2021-22/18 dated 03.01.2022.
04. It is further submitted that petitioner completed both works within the stipulated time, and completion certificates were issued in his favour. The respondent No.4 also certified vide certificate dated 06.06.2023 that the petitioner had successfully and physically completed the allotted works.
05. It is submitted that against the first work, an amount of Rs.1,70,000/- was released, leaving a balance of Rs.18,120/- outstanding and against the second work, only Rs. 49,000/- was released, leaving a balance of Rs.1,54,200/- outstanding. The petitioner’s security amount also

remained unreleased. The petitioner repeatedly approached the respondents for release of the outstanding payments and also submitted applications seeking necessary directions for measurement, preparation and submission of bills. Despite the same, the outstanding amounts were not released.

After addressing arguments for some time, learned counsel for the petitioner submitted that the petitioner would be satisfied if the present writ petition is disposed of with a direction to the respondents to treat the writ petition as a representation and decide the same within a stipulated time frame by passing a reasoned and speaking order.

In view of the submissions so made, the present writ petition is disposed of at the pre-notice stage, with direction to respondents to treat the writ petition as a representation, to be laid before the respondent No.1 Commissioner/Secretary to Government, Rural Development Department, Jammu, who shall examine and consider the same by passing a speaking
order at the earliest, preferably within a period of three months from the date of receipt of a certified copy of this order.
08. Petition stands disposed of along with connected application(s).
