Accused Nos.1 to 3 in Crime No.34/2026 registered by the Madigeshi Police Station, Tumakuru, for the offences - 3 - HC-KAR NC: 2026:KHC:31910 CRL.P No. 7109 of 2026 punishable under Sections 115(2), 118(1), 76, 352, 329(4) read with Section 3(5) of BNS, 2023 are before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the petitioners and the learned HCGP for the respondent. 3. FIR in Crime No.34/2026 was registered by the Madigeshi Police Station, Tumakuru, for the aforesaid offences against the petitioners based on the first information received from Suneetha, W/o Ravikiran. Apprehending the arrest in the said case, petitioners have filed Crl.Misc.No.5147/2026 before the jurisdictional Sessions Court which was rejected on 02.05.2026. Therefore, they are before this Court. 4. The material made available to the Court would go to show that in respect of the alleged incident that has taken place on 20.03.2026, there is a case and counter case registered by the very same police in Crime Nos.33/2026 and 34/2026. FIR in Crime No.33/2026 was registered for offence punishable under Sections 115(2), 109, 352 of BNS, 2023 and - 4 - HC-KAR NC: 2026:KHC:31910 CRL.P No. 7109 of 2026 Section 3(1)(r)(s) of Schedule Cast and Schedule Tribes (Prevention of Atrocities) Act, 2015 against one Shivaprakash based on the first information received from Mahipala. The first accused in the present case namely Shivaprakash and Ramesh are the injured victims in Crime No.33/2026. 5. A reading of the FIR in the Crime No.33/2026 would go to show that Ramesh who is the first petitioner herein, suffered grievous injuries in the said incident and he was admitted in a Government Hospital at Tumkur and subsequently shifted to Victoria Hospital in Bengaluru. The present case was registered subsequent to the registration of FIR in Crime No.33/2024. 6. Under the said circumstances, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following: ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.34/2026 registered by the Madigeshi police station, - 5 - HC-KAR NC: 2026:KHC:31910 CRL.P No. 7109 of 2026 Tumakuru for the offences punishable under Sections 115(2), 118(1), 76, 352, 329(4) read with 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioners shall regularly appear before the Trial Court without fail, unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
