THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: a) Issue a writ in the nature of Mandamus directing Respondent No.4 to consider the dated 18-03-2026 - 3 - HC-KAR NC: 2026:KHC:31339 WP No. 15761 of 2026 objections/representation submitted by the Petitioner vide ANNEXURE-A and pass a detailed, reasoned, and speaking order strictly in accordance with Standing Order 1059(5) of the Karnataka Police Manual and the law laid down by this Hon'ble Court in Sri. B.S. Prakash v. State of Karnataka & Others within a time frame to be fixed by this Hon'ble Court; b) Grant any other writ, order or direction as this Hon'ble court deems fit and proper under the circumstances of this case. 2. The petitioner being arrayed as accused no.13 in Crime No.206/2011 of Sullia Police for offences under Section 143, 147, 148, 341, 324, 353, 332, read with 149 and Section 2(A)(B) of the Karnataka Prevention of Destruction and Loss of Property Act, 1991 as also being arrayed as an accused in Crime No.167/2012 and CC No.386/2013, a rowdy sheet was opened in respect of the petitioner. 3. The submission of the learned counsel for the petitioner is that in all the three of the proceedings, the Petitioner has been acquitted. In that background the petitioner was shocked to receive a show cause notice intending to extend the maintenance of the rowdy sheet as regards which the petitioner submitted his representation/objection on 18.03.2026 which has not been considered by the - 4 - HC-KAR NC: 2026:KHC:31339 WP No. 15761 of 2026 respondent and it is in that background that the petitioner is before this Court. 4. A notice having been issued on 10.03.2026, the petitioner having replied to the same on 18.03.2026, it was but required for the respondents to consider the same and pass necessary orders before extending the rowdy sheet maintained by the respondents more so when according to the petitioner, all the criminal proceedings against the petitioner have ended in acquittal. In that view of the matter, this Court passes the following: ORDER i) The Writ Petition is allowed. ii) A mandamus is issued directing respondent No.4 to consider the representation/objections dated 18.03.2026 submitted by the Petitioner at Annexure-A within a period of four weeks from the date of receipt of copy of the order.
