Learned counsel for the petitioner submits that the petitioner-Trust purchased the land in question, namely 22 guntas in Survey No.75/1B of Ganangoor Village, K.Settihalli Hobli, Srirangapatna Taluk, Mandya District, under a registered sale deed dated 08.02.2008. Although there was a delay on the part of the petitioner-Trust to seek mutation entry in the revenue records, nonetheless, the petitioner-Trust filed an application before the Deputy Commissioner, Mandya District, during January 2025, seeking mutation entry in the revenue records. The Deputy Commissioner issued a communication to the Tahsildar, Srirangapatna Taluk, on 25.11.2025 as found at Annexure-D, directing the Tahsildar to look into the matter and pass appropriate orders. However, the Tahsildar has issued the impugned endorsement at Annexure-A dated 05.01.2026, stating that the RTC now stands in the name of the government pursuant to orders passed in M.R.No.H8/2017-18 dated 25.09.2017. Learned counsel submits that the petitioner sought information from the Assistant Commissioner, Pandavapura Sub-Division, regarding the proceedings in LRF.84/2015-16, which is the basis for the mutation entry in MRH.8/2017-18, however, an endorsement was issued from the office of the - 4 - HC-KAR NC: 2026:KHC:17991 WP No. 9101 of 2026 Assistant Commissioner as found at Annexure-E dated 02.02.2026 stating that no records are available in the Office of the Assistant Commissioner in that regard. Learned counsel would therefore submit that the impugned endorsement at Annexure-A should be quashed and a direction should be issued to the Tahsildar to mutate and enter the name of the petitioner-Trust in the revenue records. 3. Learned Additional Government Advocate raises a preliminary objection that when it is true that the name of the government has been entered in the revenue records in terms of mutation order bearing No.MRH.8/2017-18, it would not be permissible for the Tahsildar to enter the name of the petitioner unless the petitioner raises a challenge to the entry of the name of the government in the RTC in accordance with law and the same is set aside. 4. There is substance in the submission made by the learned Additional Government Advocate. Unless and until the entry made in the RTC showing the name of the government in terms of the orders said to have been passed by the competent authority is challenged by the petitioner and the same is set - 5 - HC-KAR NC: 2026:KHC:17991 WP No. 9101 of 2026 aside in accordance with law, such directions cannot be issued to the Tahsildar, to enter the name of the petitioner-Trust in the revenue records. 5. With these observations, the writ petition stands disposed of reserving liberty to the petitioner-Trust to raise a challenge to the mutation entry. Ordered accordingly.
