Accused nos.1 and 2 in Crime No.133 of 2026 registered by Govindapura Police Station, Bengaluru for offence punishable under Section 311 R/w 3(5) of BNS, 2023 & Section 4, 25(1-B)(b) of Indian Arms Act, 1959 are before this Court, in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. FIR in Crime No.133 of 2026 was registered by Govindapura Police Station for the aforesaid offence based on the first information dated 11.04.2026 received from Sri Ku. Ahmedi Umama son of Ajmail Ahmed. In the said case, petitioners herein were arrested on 12.04.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.25395 of 2026, was rejected on 02.05.2026. Perusal of the material on record would go to show that, the alleged incident had taken place at about 07.30 p.m. on 12.03.2026, first information is belatedly filed on 11.04.2026, which is after a period of nearly one month from the alleged date of incident. In the typed first information dated 11.04.2026, it is stated that, the first informant and his friend who were intending to do business, had contacted the petitioners herein over phone on 06.03.2026 and had enquired with them with regard to branded clothes. The petitioners allegedly represented to the first informant and his friend that they were owning a branded clothes warehouse at HBR layout in Bangalore and had allegedly asked the first informant to come near the said shop with an amount of ₹.10,00,000/- for the purpose of purchasing the branded clothes. Accordingly, on 12.03.2026 the first informant and his brother had gone to HBR layout with a sum of ₹.10,00,000/- and the accused persons, who came there in a motorbike allegedly snatched the bag in which the first informant was carrying sum of Rs.10,00,000/- and thereafter threatened the first informant and his brother with a weapon and escaped from the spot. - 4 - HC-KAR NC: 2026:KHC:31926 CRL.P No. 7095 of 2026 4. The inordinate delay of 1 month in approaching the police is not satisfactorily explained. Considering the same and also the nature of allegations found in the first information, I am of the opinion that they prayer made by the petitioners for grant of regular bail needs to be answered affirmatively. 5. Accordingly, the following: ORDER Criminal petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.133 of 2026 registered by Govindapura Police Station, Bengaluru for offence punishable under Section 311 R/w 3(5) of BNS, 2023 & Section 4, 25(1-B)(b) of Indian Arms Act, 1959, subject to the following conditions: a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; - 5 - HC-KAR NC: 2026:KHC:31926 CRL.P No. 7095 of 2026 c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future: e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
