This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 97/2025 registered at Police Station Singhoda, District - Mahasamund (C.G.), for the offence punishable under Sections 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. The prosecution story, in brief, is that the SHO of Police Station, Singhoda, received secret information that a silver-coloured Tata Zest car bearing registration No. UP 92 51313, which was coming from Odisha, was carrying contraband. Acting upon the said information, a raid was conducted, during which the driver of the vehicle was ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.07.03 11:06:34 +0530 2 apprehended and identified himself as Kushal Singh. A search of the vehicle was allegedly conducted, during which the police recovered a total of 50 kilograms of moist contraband (ganja). The said contraband was allegedly found concealed inside two plastic sacks. The main accused, Kushal Singh, was arrested, and during the course of investigation, he made a memorandum statement wherein he stated that one Raghavendra had purchased the seized 50 kilograms of ganja from a hotel in Odisha. Based on the said memorandum statement of the co- accused, the police arrested another co-accused, namely Raghavendra Rajput. Thereafter, Raghavendra Rajput was also interrogated, and he allegedly made a further memorandum statement wherein he stated that he had travelled to Odisha to procure the contraband at the behest of the present applicant, Deepu Rajput, along with other co-accused persons, namely Shyam Shivhare and Pawan Shivhare, and that the seized ganja was to be delivered to them. On the basis of the aforesaid allegations, an FIR was registered on 24.12.2025 at Police Station Singhoda, District Mahasamund, against co-accused Kushal Singh under Section 20(b) of the N.D.P.S. Act. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He submits that the applicant never involved in any commission of crime as the contraband psychotropic substance was not seized from the exclusive possession of applicant and only on the basis of memorandum of co-accused applicant has been roped as accused in the present case. He also submits that the present applicant has been in jail since 20.02.2026, conclusion of the trial may take quite long time. Accordingly, he prays for enlarging the applicant on regular bail. 3 4. Learned counsel appearing for the State/non-applicant opposes the bail application and submits that the charge-sheet has been filed before the competent Court in the present case. He further submits that the co- accused, namely, Kushal Singh, was allegedly transporting 50 kg of Ganja, which is much above the commercial quantity. The name of the present applicant came to light on the basis of the memorandum statement of the said co-accused, Kushal Singh, indicating that the offence is part of an organized crime. Therefore, the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the overall facts and circumstances of the case, particularly the allegation that the co-accused, Kushal Singh, was apprehended while transporting 50 kg of Ganja, which is much above the commercial quantity, and that the name of the present applicant surfaced during the investigation on the basis of the memorandum statement of the co- accused, prima facie indicating his involvement in the commission of the offence, indicating that it is an organized crime, therefore, I am not inclined to grant regular bail to the present applicant. 7. Accordingly, the bail application of the applicant - Deepu Rajput, involved in Crime No. 97/2025 registered at Police Station Singhoda, District - Mahasamund (C.G.), for the offence punishable under Sections 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 4 9.
