Though the petition is listed today for orders, with the consent, it is heard. 3. The petition is filed seeking following reliefs: - 3 - HC-KAR NC: 2026:KHC:31354 WP No. 2107 of 2024 a) Issue a writ of mandamus, or any other appropriate writ, or order or direction, declaring that the action of withdrawing the light duties allotted to petitioner by the 2nd respondent in terms of the letter bearing No. KARASA/MY VI/C/E-5/4174/2023-24 dated 12.12.2023 issued by the 2nd respondent, copy of the same is produced as Annexure-M (in so far as the petitioner is concerned) as arbitrary, illegal and violative of Section 47 of the Disabilities Act; b) Issue a writ of mandamus directing the 2nd respondent to secure the records pertaining to the medical assessment and examination conducted on the petitioner during the years 2003, 2015, 2020 and 2023, including the medical certificates issued by the medical boards from time to time and if the medical certificates so produced sufficiently disclose the nature and extent of disability acquired by the petitioner, direct the 2nd respondent to consider the same for continuing the petitioner on light duties, which he has been discharging from the year 2003, to meet the ends of justice; c) Pass such other order/ orders as this Hon'ble Court deems fit to pass, including the costs of the petition throughout, to meet the ends of justice. - 4 - HC-KAR NC: 2026:KHC:31354 WP No. 2107 of 2024 4. Counsel appearing for the respective parties advanced their submissions. The arguments were heard, and the records were carefully perused. 5. Owing to the petitioner's physical disability, he was assigned light duty, which has been continued by the Corporation pursuant to the interim order passed by this Court. Counsel appearing for both parties jointly submitted that, as on the date of hearing, the petitioner is continuing to discharge light-duty work. The said submission is taken on record. 6. Counsel for the petitioner further submitted that the petitioner is due to attain the age of superannuation on 31.07.2026. 7. Having regard to the fact that the petitioner is due to attain the age of superannuation on 31.07.2026, the Corporation is directed to continue assigning light-duty work to the petitioner until the date of his superannuation. - 5 - HC-KAR NC: 2026:KHC:31354 WP No. 2107 of 2024 8.
