Dutta …for the State This present criminal proceeding has been initiated based on a complaint filed by the opposite party no.2. Following the complaint, an F.I.R. was registered at Gariahat Police Station being Case No.161 of 2020 dated July 3, 2020 under Sections 504/506/114/324/511 of the Indian Penal Code, 1860. It appears that the criminal case is a result of a family dispute. Learned counsel appearing on behalf of the State submits that the petitioners are willing to surrender before the learned Magistrate. In view of the aforesaid submission, the warrant of arrest issued against the petitioners is stayed for a period of one month from the date of this order, subject to the condition that the petitioners shall surrender before the learned Magistrate within the said period. In the event the petitioners surrender before the learned Magistrate, any application for bail filed by them shall be considered 2 and decided in accordance with law without being influenced by this order. In the event the petitioners fail to surrender in terms of this order within the stipulated period, the warrant of arrest shall stand revived automatically, and the learned Magistrate shall be at liberty to execute the same in accordance with law. Accordingly, CRR 1838 of 2026 along with CRAN 1 of 2026 is thus disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings. (Kausik Chanda, J.)
