Earlier prayer for bail of this petitioner was rejected vide order dated 05.03.2025 passed in B.A. No.10951 of 2024 on merit by the Co- ordinate Bench of this Court. The petitioner, above-named is in custody has renewed his prayer for bail in connection with S. T. Case No.360 of 2024 (arising out of Hussainabad [Palamau] P.S. Case No.124 of 2024 corresponding to G.R. Case No.1257 of 2024] for the offence registered under Sections 304B, 34 of the IPC. It is submitted by the learned Sr. counsel on behalf of petitioner that petitioner is in custody since 01.06.2024. The charge in this case was framed on 21.11.2024 and more than one year has elapsed, but not a single charge-sheeted witness has been examined. Indisputably, the death was suicidal in nature. The death took place after six years of marriage and there was no proximate cause to show that there was dowry demand. It is further submitted that petitioner is a poor labourer, therefore, question of making dowry demand of Rs.4 Lakhs and that too, after six years of marriage, does not arise. Learned A.P.P. opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
