Mr. Shahan Shah Mr. Soumen Barman .......for the de-facto complainant. Learned senior advocate appearing for the petitioner submits that petitioner is in custody since 21.10.2024. Records reflect that other co-accused namely, Mikail Sk and Md. Anarul Mondal @ Anarul Mandal have been granted bail. Learned advocate for the State relies upon evidence of some of the witnesses under Section 164 of the Cr.P.C. I have taken into account the factual foundations and I am of the view that Mikail Sk and the present petitioner are similarly situated. Further, the accusations are that the petitioner acted on the instruction of Anarul Mondal. The said Anarul Mondal is on bail. Learned advocate for the State additionally submits that it is the present petitioner who called the deceased and subsequently the incident happened. 2 However, having considered the period of detention and without entering into the merits of the case, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. As such, petitioner namely, Kamal Sk. @ Kamel Sk shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Tehatta, Nadia. If on bail, the petitioner shall be physically present before the learned trial Court on each and every date and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned trial Court. Additionally, petitioner shall stay outside the jurisdiction of Thanarpara and Karimpur Police Station till further order of this Court. Accordingly, CRM (M) 490 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
