Accused No. 1 in Crime No. 39/2026 registered by Shimoga Women Police Station, Shimoga District for offences punishable under Section 69, 74, 352, 115(2), 351(2) read with Section 190 of BNS 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and learned HCGP for the respondent. 3. FIR in Crime No. 39/2026 was registered by Shimoga Women's Police Station for the aforesaid offences against the petitioner herein, based on the first information dated 14.04.2026 received from the alleged victim lady aged - 3 - HC-KAR NC: 2026:KHC:31905 CRL.P No. 7242 of 2026 about 25 years. In the said case, petitioner was arrested on 14.04.2026 and remanded for judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No. 424/2026 was rejected on 11.05.2026. Therefore, he is before this Court. 4. In the first information which was filed on 14.04.2026, it is stated that the alleged victim is a married lady having minor sons. She has stated that her husband had died a year back and petitioner, who was working as a mason and staying near her house, got acquainted to her and subsequently proposed to her. She has stated that with a promise to marry her, petitioner allegedly had sexual intercourse with her multiple times. 5. On 19.03.2026, at about 12.30 a.m., when petitioner came to her house, her mother-in-law saw him and thereafter the victim allegedly insisted the petitioner to marry her. The petitioner allegedly refused to marry the victim lady and thereafter on 21.03.2026 relatives of the - 4 - HC-KAR NC: 2026:KHC:31905 CRL.P No. 7242 of 2026 petitioner came near her house and criminally intimidated her. First information was submitted belatedly on 14.04.2026, which is after a lapse of more than 3 weeks from the alleged date of incident. Petitioner is in custody for the last more than 2 months. Major portion of the investigation is completed. 6. In view of the aforesaid aspects of the matter and also considering the nature of allegations found in the first information, I am of the opinion that prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following: ORDER The Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.39/2026 of Mahila Police Station, Shivamogga registered for the offences punishable under Sections 69, 74, 352, 115(2), 351(2) read with Section 190 of BNS, 2023 subject to the following conditions: - 5 - HC-KAR NC: 2026:KHC:31905 CRL.P No. 7242 of 2026 a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
