2.
Learned counsel for the petitioner submits that the petitioner is a duly appointed Assistant Grade-II serving under the Revenue Department and has rendered his services sincerely and diligently. It is submitted that the petitioner was placed under suspension vide order dated 17.07.2025 solely on account of registration of a criminal case under Section 7 of the Prevention of Corruption Act, 1988, which is presently pending trial before the District and Sessions Court, Durg in Case No. 03/2025. It is further submitted that despite the lapse of considerable time, the suspension of the petitioner continues without any review. The petitioner has already submitted representations dated 27.11.2025 and 18.02.2026 requesting the competent authority to revoke the suspension; however, no decision has been taken thereon.Learned counsel
4 contends that prolonged suspension without periodic review is arbitrary and contrary to the settled principles of law, particularly when the criminal trial is likely to take considerable time for its conclusion. It is, therefore, prayed that the impugned suspension order dated 17.07.2025 be quashed, or in the alternative, the respondents be directed to consider and decide the petitioner’s pending representations for revocation of suspension within a time-bound period in accordance with law
3. Learned State counsel submits that if the representation submitted by the petitioner is pending consideration, the same shall be examined and decided by the competent authority in accordance with law, keeping in view the applicable circulars/ instructions of the State Government as well as the law laid down by the Hon'ble Supreme Court, within a reasonable period.
4. Heard learned counsel for the parties and perused the material available on record.
5. Considering the limited prayer made by learned counsel for the petitioner and without expressing any opinion on the merits of the case, this petition is disposed of with a direction
5 to respondent No. 2 to consider and decide the petitioner's representation (Annexure P-3) dated 27.11.2025 and 18.02.2026 regarding revocation of suspension in accordance with law, on its own merits, expeditiously, preferably within a period of 30 days from the date of receipt of a copy of this
order.
6. It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner and the competent authority shall take an independent decision strictly in accordance with law.
7. With the aforesaid observation and direction, the writ petition stands disposed of. Sd/-
