For the Respondents: Mr. Rajan Kahol, Additional Advocate General with Mr. Ravi Chauhan & Mr. Anish Banshtu, Deputy Advocates General, for the respondents-State. Mr. Mukul Sood, Advocate, for respondent No.3. Mr. Dhiraj Thakur, Advocate, for respondent No.5. ____________________________________________________ Sandeep Sharma, Judge(oral): Since despite there being directions issued by this Court vide judgment dated 22.07.2026 passed in CWP No. 12273 of 2026, titled Anita Thakur & Ors. Vs. State of Himachal Pradesh & Ors., respondents have failed to decide the representation filed by the petitioners for redressal of their grievance, they are compelled to approach this Court by way of the instant petition. 1Whether the reporters of the local papers may be allowed to see the judgment? 2 2. Before cognizance of the averments contained in the petition could be taken, Mr. Ravi Chauhan, learned Deputy Advocate General, states before this Court that representation of the petitioners, if not already decided, shall be decided expeditiously. 3. Since Co-ordinate Bench of this Court, after taking cognizance of the grievance of the petitioners, had already permitted them to file a representation before the competent authority for redressal of their grievance, coupled with the fact that the petitioners have already filed representation and the same is pending consideration before the competent authority, it may not be appropriate for this Court to entertain the present petition at this stage. 4. However, having taken note of fact that directions contained in judgment dated 22.07.2026 passed in the previous petition, detailed hereinabove, this Court deems it fit to dispose of the present petition with a direction to the competent authority to decide the pending representation filed by the petitioners before the Municipal Corporation, Shimla, as is evident from Annexure P-9, within a period of 10 days. Ordered accordingly. 5. Needless to say, the authority concerned, while doing the needful in terms of the instant order, shall afford an opportunity of hearing to the petitioners and pass appropriate orders thereon. It is made clear that no request for extension of time shall be entertained and in any eventuality, representation of the petitioners, as detailed hereinabove, shall be decided within the time granted by this Court. Till the disposal of the representation 3 filed by the petitioner, no construction work relating to the hospital shall be commenced at the site. Petition stands disposed of in the aforesaid terms along with pending application(s), if any. (Sandeep Sharma), Judge September 25, 2026 (Sunil)
