JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner, complainant – wife is before this Court calling in question proceedings in C.C.No.6133/2025, pending before the II Additional Chief Judicial Magistrate, Bengaluru Rural, for the offences under Sections 69 and 115(2) of the BNS, 2023, seeking permission to compound the offences, on the score that the husband and wife have reunited and living together happily. 2. Heard Sri Nagaraj N.T., learned counsel for petitioner and Smt. Rashmi Patel, learned High Court Government Pleader for respondent No.2. - 3 - HC-KAR NC: 2026:KHC:28633 CRL.P No. 7216 of 2026 3. Learned counsel for the petitioner would submit that the parties to the lis have arrived at settlement and the couple have reunited and therefore, they are before the Court seeking permission to compound the offences. They have also appended a compromise deed entered into between them and undertake to abide by the conditions indicated therein, before this Court. 4. The compromise petition reads as follows: “This Compromise deed is made at 1th Day of May 2026 BETWEEN: Sri Praveen Raj.O, S/o Sri Obiah Nayak, aged about 26 years, R/at No:373, 1st Main, 2nd Cross, Ramagondanahalli, Whitefield Post, Bengaluru North, Bengaluru 560056. HEREINAFTER CALLED AS HUSBAND (Which expression shall unless repugnant to the contacts, means and includes his heirs, executors, administrators and assigns of one Part.) AND: Smt Poorima. D/o Late Sri Nagarai, aged about 26 years, R/at Bangarapet Circle, Amdbedkar Nagar, Kolar, Kasaba Hobli, Kolar Town 563101 HEREINAFTER CALLED AS WIFE (Which expression shall unless repugnant to the contacts, means and includes his heirs, executors, administrators and assigns of Second Part.) WHEREAS the parties are husband and wife and their marriage having been solemnized on 16-3-2026 as per Hindu Relations and Ceremonies - 4 - HC-KAR NC: 2026:KHC:28633 CRL.P No. 7216 of 2026 And WHEREAS the parties have realised their likes and dislikes, temperamental moods, nature and general approach to life and are so different to each other and could not get along well with each other And WHEREAS on account of such differences between the parties they have frequent quarrels and police complaints and courts cases in the past And WHERAS from hereon the parties decided to live together peacefully as one family And WHEREAS the parties have soughted out the problems amicably and entering into memorandum of understanding And WHEREAS the parties have worked out the terms and conditions of their agreement and decided to reduce the same in writing. NOW THIS DEED, It is mutual agreed by and between the parties as follows:- 1. That the parties do hereby declare and confirm the Memorandum of Understanding does not amount to any collusion on their part. 2. That the parties will be happily for hereon as husband and wife peacefully and happily. 3. That, due to the issues sorted out there would be peace in their family life and will not quarrel on any issues.” In the light of the afore-quoted compromise petition, though the offence alleged against respondent No.1 in the case at hand inter alia is the one punishable under Section 69 of the BNS, as it is a matrimonial dispute and the couple have - 5 - HC-KAR NC: 2026:KHC:28633 CRL.P No. 7216 of 2026 reunited and living together happily, I deem it appropriate to terminate the proceedings against respondent No.1. 5. 5. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. (ii) The proceedings C.C.No.6133/2025, pending before the II Additional Chief Judicial Magistrate, Bengaluru Rural, stand quashed. I.A.No.1/2026 also stands disposed, as a consequence.
