1 2026:CGHC:27248 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 5852 of 2026 Arun Kumar Ram S/o Mahavir Ram, Aged About 24 Years R/o Manjjhigaon P.S. Manjhigaon District Gadwa Jharkhand ... Applicant(s) versus State Of Chhattisgarh Through, Station House Officer, Police Station Tilda Nevra, District Raipur C.G. ... Non-applicant(s) For Applicant : Mr. Bharat Lal Sahu, Advocate. For Non-applicant/State : Ms. Ritika Verma, Panel Lawyer. Hon'ble Shri Ramesh Sinha , Chief Justice Order on Board 02.07.2026 1. The applicant has preferred this First Bail Application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.46/2026, registered at Police Station- Nevra, District-Raipur (C.G.) for the offence punishable under Sections 105, 125(a) and 125(b) of B.N.S. 2. Case of the prosecution in brief is that the complainant lodged an FIR against the applicant that it is alleged that on 30.01.2026, at about 8:00 P.M., while the complainant along with Girdhari Sen and Pradeep Yadu was standing near Bais Mile Chowk, they saw high- KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 way vehicle bearing Registration No. CG10BJ5311 being driven in a rash and negligent manner at a very high speed. The driver of the said vehicle first hit a motorcycle bearing Registration No. CG04NK8497 from behind, on which Dhanaram Yadu and Lakshminath Yadu were travelling, and thereafter, after proceeding about 700 metres, struck another motorcycle bearing Registration No. CG04NL8814 from behind, on which Devendra Kumar Yadav and Omprakash Nishad were travelling. As a result of the accident, Dhanaram Yadu, Lakshminath Yadu and Devendra Kumar Yadav died on the spot, while Omprakash Nishad sustained grievous injuries and was allegedly dragged by the High-way vehicle for a considerable distance before being admitted to the hospital for treatment. It is further alleged that after causing the accident, the driver attempted to flee from the spot, abandoned the vehicle near Simga Bypass Road and escaped. On the basis of the aforesaid report, the present crime was registered against the driver of the High-way vehicle. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case and has not committed any offence as alleged by the prosecution. It is contended that at the time of the incident, the deceased and the injured themselves were driving their motorcycles in a rash and negligent manner and dashed against the applicant's vehicle. It is further submitted that the applicant had no knowledge of the accident and there was neither any intention nor any motive on his part to commit the alleged offences. He further submits that the 3 applicant was driving the vehicle cautiously and has been implicated merely on the basis of suspicion without there being any cogent material connecting him with the alleged crime. It is further contended that the essential ingredients of the offences punishable under Sections 105, 125(A) and 125(B) of the BNS are not attracted against the present applicant and that the prosecution has failed to collect sufficient material to substantiate the allegations. It is further submitted that the applicant is in jail since 01.02.2026 and in the present case, charge-sheet has been filed before the competent Court and the applicant has no criminal antecedent, therefore, he prayed that the applicant be enlarged on regular bail. 4. On the other hand, learned State counsel opposes the prayer for grant of bail and submits that the allegations against the present applicant are extremely grave in nature. It is submitted that while driving the Hi-way vehicle in a rash and negligent manner, the applicant caused a fatal accident in which three persons, namely, Dhanaram Yadu, Lakshminath Yadu and Devendra Kumar Yadav, came under the wheels of the said vehicle and lost their lives. It is further submitted that another victim, Omprakash Nishad, sustained grievous injuries in the said incident and remained hospitalized for about 22 days for treatment. Considering the manner in which the accident was caused, the gravity of the offence, the loss of three human lives and the grievous injuries suffered by the injured victim, it is prayed that the application for grant of bail deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case 4 diary. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of the allegations, the fact that the applicant, while allegedly driving the Hi-way vehicle in a rash and negligent manner, first dashed one motorcycle from behind and thereafter hit another motorcycle, as a result of which three persons, namely, Dhanaram Yadu, Lakshminath Yadu and Devendra Kumar Yadav, lost their lives and another victim, Omprakash Nishad, sustained grievous injuries and remained hospitalized for about 22 days and the manner in which the incident is alleged to have been committed, the material collected during the course of investigation, the applicant is in judicial custody since 31.01.2026 and the charge- sheet has already been filed before the competent Court, this Court is of the considered opinion that, at this stage, no case for grant of bail is made out. 7. Accordingly, the bail application of the applicant namely Arun Kumar Ram, involved in Crime No.46/2026, registered at Police Station- Nevra, District-Raipur (C.G.) for the offence punishable under Sections 105, 125(a) and 125(b) of B.N.S., is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/- (Ramesh Sinha) Chief Justice 0. Kunal
