As per the prosecu*on case, on 07.08.2025, a police party was on patrol duty, when they no*ced two young persons coming by foot towards the railway track of Subhash Road. At the sight of the police party, they started fleeing away and one of them was apprehended, who disclosed his name as Lucky son of Gora Singh. The other boy ran away. Lucky disclosed the name of that boy to be Manik son of Kishori Lal. From the possession of Lucky, 150 grams of heroin and ₹2,650/- as drug money were recovered, which were taken into possession aFer making necessary statutory compliances. It is further the prosecu*on case that in the disclosure statement of Rajpal Singh @ Raja, the pe**oner Robinjit Singh @ Rahul Bhangura was nominated to be involved in the crime. Pe**oner was arrested on 22.10.2025, but nothing was recovered from him. Inves*ga*on is already complete. Challan has already been filed. 3.
It is submiHed by learned counsel that pe**oner has been falsely implicated; that no recovery has been effected from him; that he was nominated only on the basis of the disclosure statement of the co- accused, which has no eviden*ary value; that inves*ga*on is already complete and that trial is likely to take long *me to conclude and so, considering his custody period, he be allowed regular bail. 4. No*ce of mo*on. 5. Mr. Ravneet Singh Joshi, DAG, Punjab, accepts no*ce on behalf of the respondent-State. Though, learned State counsel concedes the factual posi*on that no recovery was effected from the present pe**oner and that his name has surfaced only in the disclosure statement of the co- accused and that no other incrimina*ng material has been found against him, but it is contended that the contraband recovered from the co- accused falls in the commercial category. It is further stated that the pe**oner is involved in six more cases. 6. Heard. It is not disputed that no recovery has been effected from the pe**oner despite conclusion of inves*ga*on and thus, the only incrimina*ng circumstance against him is the disclosure statement of the co-accused. The eviden*ary value of such a disclosure statement is to be considered during trial. Pe**oner is in custody for the last more than 7 YOGESH MEHTA 2026.06.17 18:58 I attest to the accuracy and integrity of this document
