Uncle and Aunt (Chacha & Chachi) of the victim have appeared virtually and record objection in granting bail the applicant. 2. The applicant has preferred this 3rd bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act 2023 for grant of regular bail as he is arrested in connection with crime No.432/2025, registered at Police Station – Pamgarh, District- Janjgir-Champa (C.G.) for offence punishable under Sections 74, 64(2)(m), 351(3), 115(2) of BNS and Sections 6 & 8 of the POCSO Act, 2012. 3. First bail of the applicant was dismissed as withdrawn vide order dated 15.01.2026 passed in MCRC no.9704/2025. The prosecution's case, in short, is that the applicant allegedly committed sexual assault on the minor victim at her house on the night of 13.09.2024. It is further alleged that between 15.09.2024 and 25.06.2025, the applicant committed sexual intercourse with the victim on various occasions against her will and without her consent under the pretext of marriage due to which she also became pregnant. It is further alleged that the applicant had given her some pills due to which her child was aborted. Following a report lodged in this regard, the applicant was arrested on 15.09.2025. 5. Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the crime in question. The change in circumstances, as compared to the first bail application, is that a previous FIR was lodged against the applicant under Sections 294, 323, 506 read with 34 of the IPC, in which he has been acquitted in the Lok Adalat pursuant to a compromise arrived at between the parties. She further submits that this is the matter of consent, there was a love affair between the applicant and the victim and as the applicant denied to perform marriage with her, a false report has been lodged by he victim against him. The Applicant has been in custody since 15.09.2025. Out of 21 prosecution witnesses, only 5 have been examined till date, and the trial is likely to take considerable time for conclusion. In view of the above, it is prayed that the Applicant may be enlarged on bail. 6. Per contra, Learned Counsel appearing on behalf of the State opposes the bail application and submits that at the time of the incident, the victim was a minor. She has supported the prosecution case and has also stated that she became pregnant by the Applicant and subsequently underwent an abortion. There has been no change in circumstances as compared to the first bail application. Therefore, considering the gravity/nature of the offence, the Applicant does not deserve to be granted bail. 3 7. I have heard learned Counsel appearing for the parties and perused the material available on record. 8. Considering the facts and circumstances of the case and the evidence collected by the prosecution against the applicant, without commenting on merits of the case, I am not inclined to release the applicant on bail. 9. Accordingly, the bail application is rejected. 10. However, looking to the detention period of the applicant, the concerned Trial Court is directed to expedite the trial and to ensure that the trial is concluded as early as possible preferably within a period of 4 months from the date of receipt of copy of this order.
