This transfer petition is filed by the wife for transfer of M.C.No.10/2026 filed by the husband for divorce before the Senior Civil Judge and JMFC at Mudigere to Principal Family Judge at Bengaluru. Petitioner stated that she is residing with her parents along with minor child aged 8 years at Bengaluru and she further stated that initially both of them were residing in Bengaluru. The distance between Bengaluru and Mudigere is 260 kilometers. - 3 - HC-KAR NC: 2026:KHC:29571 CP No. 158 of 2026 3. Learned counsel for the petitioner stated that petitioner has met with an accident and underwent two surgeries and cannot move. Whereas, the learned counsel for the respondent stated that respondent was working as a Driver in BMTC previously at Bengaluru and now, he is transferred to Mudigere. As such, he filed case at Mudigere and petitioner has sustained only ligament tear as per the medical record. It is stated in the petition that petitioner was working in a Vijayanagara Clinic, Bengaluru on part-time basis. 4. Considering the fact that the petitioner is residing with a minor child at Bengaluru, as it is inconvenient for her to travel 260 kms, this Court finds that it is just and reasonable to transfer M.C.No.10/2026 from Senior Civil Judge, Mudigere to Principal Family Court, Bengaluru. 5. Respondent can file chief affidavit and he is at liberty to be cross-examined either through Commissioner or through Video Conference.
