p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.2189 of 2026 Solei @ Soleman Khan …. Petitioner Mr. S. K. Dash, Advocate -Versus- State of Odisha …. Opposite Party Mr. Satyabrata Panda, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 06.07.2026 04. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Tigria P.S. Case No.134 of 1999 corresponding to G.R. Case No.468 of 1999 pending in the court of learned J.M.F.C., Tigiria on the grounds stated therein. 3. Perused the FIR as at Annexure-1. This Court had earlier directed the State to submit the case diary and medical examination report of the victim and also her statement recorded under Section 183 BNSS which have not been received as informed to the Court by Mr. Panda, learned ASC for the State. Recorded the submission of Mr. Dash, learned counsel for the petitioner with reference to the FIR. The said report is of the year 1999. It is informed to the Court that the parties have married elsewhere and settled in life. The allegation is about sexual mischief committed by the petitioner p. 2 with the promise of marriage leading to the pregnancy of the victim. The parties are related to each other as made to appear from the report itself. Considering the above facts and since it is claimed that non-bailable warrant of arrest is pending execution against the petitioner, this Court, considering the same, is inclined to direct him to surrender before the Court of learned J.M.F.C., Tigiria for being released with conditions even though a case for pre-arrest bail is not made out. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of. It is directed that in the event, the petitioner surrenders before the learned J.M.F.C., Tigiria in connection with Tigria P.S. Case No.134 of 1999 corresponding to G.R. Case No.468 of 1999 within a fortnight from today, he shall be released on bail upon furnishing bail bond of Rs.30,000/-(rupees thirty thousand only) with one solvent surety for the like amount and such other terms and conditions as deemed just and proper in the facts and circumstances of the case. 6. Issue urgent certified copy as per rules. (R.K. Pattanaik) Judge Sumitra
